The importance of obtaining patent protection for products associated with personalised medicine is increasing with the rise in use and development of such products. Like personalised medicine, patent specifications and filing strategies must be tailored to each specific technology to obtain optimal protection. Recent court decisions have made patent protection of diagnostics and natural products more difficult to obtain. However, the use of diverse and non-traditional strategies can in some cases overcome the issues introduced by these decisions. This presentation will explore strategies for obtaining patent protection for products associated with personalised medicine, with a particular focus on diagnostics and natural products such as peptides and proteins.
